Terms and conditions

1. This offer is public and addressed to an indefinite number of persons (hereinafter referred to in the singular as the “User”, or in the plural as “Users”, or in the singular as the “Client” or “Consumer”, or in the plural as “Consumers”, or in the singular as the “Guest”, or in the plural as “Guests”), who wish to find and book accommodation for leisure on our platform. The terms are the same for all users.

2. Each Party guarantees to the other Party that it has the necessary legal capacity, as well as all rights and powers required and sufficient to conclude and perform the Agreement in accordance with its terms.

3. The text of the Public Offer (Agreement) is always available on the official website fomich.ua.

4. The User agrees to the disclosure to third parties of information arising in connection with the performance of this Public Offer (Agreement) and the provision of services to the User.

Public Offer Agreement - a public agreement, a sample of which is available on the Platform.

1. Booking – reservation of accommodation for temporary stay on the Platform, regardless of whether you pay for it directly on the Platform (prepayment at the time of booking) or later (during its actual use).

2. Platform – an internet website owned by the Platform Owner, through which you have the opportunity to book accommodation for temporary stays.

3. Accommodation – a booking object for temporary stay at the Hotel's location, in a specially equipped residential premises (room) according to the booking request, owned by the Owner.

4. Owner – a person who offers accommodation for temporary placement.

5. User – an individual and/or legal entity who searches for and books accommodation on the Platform, has agreed to these Terms and has registered on the Platform.

6. Personal Account – a personal account on the Platform, through which you can book accommodation on our Platform.

7. Prepayment – a payment made by you at the time of booking accommodation, rather than during its actual use.

1.  A Platform User may complete the registration procedure on the Platform, as a result of which a unique Platform Client account is created and access to the Personal Account is provided.

2.  The Platform User registers on the Platform using an email address and a password known only to them, or by logging in through their social media account. During registration, the Platform User also provides additional information: residential address, contact phone number, and clicks the “create account” button. The registration date on the Platform shall be considered the date when the Platform User creates their Personal Account.

3.  The Platform User confirms that they are solely responsible for the security of the data used to access the Personal Account.

4.  The Platform User is solely responsible for all actions performed by them on the Platform and their consequences. All actions of the Platform User on the Platform under their account shall be considered as actions performed by the Platform User themselves.

1. Using the Platform, you can book accommodation for temporary stays based on criteria such as booking dates, number of guests, price, reviews, etc.

2. Our Platform only displays accommodation whose owners have contractual relationships with us. Accordingly, any information about accommodation available on our Platform, including descriptions of amenities, availability, accommodation prices, and cancellation policies, is based on the information provided directly by the Accommodation Owner.

3. By making a Booking, you agree to comply with the rules displayed during the Booking process, including but not limited to the cancellation policy of the Accommodation Owners and any other rules, standards, or requirements (age restrictions, security deposits, additional charges for group bookings, extra beds, catering services, pets, acceptance of payment cards, etc.) specified in the accommodation description on the Platform, on the Owners’ pages, in the fine print, during booking confirmation, or on the receipt. You are required to carefully read all accommodation terms, rules, standards, policies, and requirements before booking.

4. After making a booking, the Platform sends you a booking confirmation message by email, which includes, in particular: the Booking number, accommodation address, stay dates, including check-in and check-out times, total Booking cost, contact information of the Accommodation Owner and Platform support service, accommodation terms, and cancellation conditions. Once you receive confirmation of your Booking, a temporary accommodation services agreement is concluded directly between you and the Accommodation Owner. Please note that when the confirmation and fulfillment of the Booking are carried out directly by the Owner, we are not a party to the contractual relationship.

1. By making a Booking, you agree to pay all charges related to your booking, including temporary accommodation services and applicable commissions, all applicable fees and taxes, such as the tourist tax, and any other required payments specified during the booking process.

2. You must pay for the accommodation in full or partially at the time of Booking. This depends on the rules established directly by the Accommodation Owner, which you will be informed about during the accommodation booking process.

3. You can make a prepayment using a debit/credit card or another payment method.

4. After full payment, the Platform sends you a payment receipt (invoice) by email. The receipt includes your details, the Platform’s details, the booking number, stay dates, and the total payment amount.

5. Please note that the Prepayment may be final and non-refundable. Before making a Booking, carefully review the Prepayment rules described by the Accommodation Owner and available during the Booking process.

6. In addition, if your payment method is in a currency different from the payment currency, your bank may charge additional fees.

1. All objects (any results of intellectual activity) posted on the Platform, including but not limited to: information materials expressed in any objective form, including video, graphic images, text, and other materials, are objects of exclusive rights of the Platform Owner or other persons with whom the Platform Owner has reached an agreement regarding the use and placement of such objects on the Platform.

2. The Platform User bears full responsibility for any actions performed by them using their Personal Account, as well as for any consequences that could have been caused or were caused by such use.

We provide information services through the Platform. We cannot guarantee that the operation and/or content of the Platform will be uninterrupted and free from errors. We cannot guarantee that the Platform will operate properly on all devices and under all special conditions. However, we will make all reasonable efforts to ensure the provision of high-quality services.

1. Unless otherwise provided by law, we shall not be liable for any special, indirect damages or losses of any other kind arising from or in any way related to the use or inability to use our Platform, regardless of the basis of such liability (breach of contract, tort liability, failure to perform essential obligations, or otherwise), even if we have been informed of the possibility of such damages and losses.

2. We shall not be liable for any damages, expenses arising from or in any way related to any violation by you of these Terms or the accommodation Owner’s rules; violation by you of any laws, regulations, or rights of third parties; or your interaction with any accommodation Owner, including, but not limited to, any injuries, damages (whether compensatory, direct, incidental, indirect, or otherwise) of any kind arising as a result of such interaction.

3. You may not submit claims of any kind against FOP Kodzayev E.E. for failure to perform any of our obligations under the Terms as a result of force majeure circumstances — circumstances beyond our control, including, but not limited to, war, strikes, lockouts, delays of any subcontractor, accidents of any kind, pandemics, epidemics, political or civil unrest, force majeure events caused by actions of the state or government, including imposed regulatory measures, or actions of any other authority, or any other circumstance beyond our reasonable control.

1. These Terms are governed by the legislation of Ukraine. All disputes that may arise in connection with these Terms, including any issues related to the performance, violation, or termination of these Terms, shall be resolved through negotiations. If we cannot reach an agreement regarding the dispute within thirty (30) days, the dispute shall be submitted to and finally resolved by the competent court of Ukraine in accordance with the applicable legislation.

1. We reserve the right to change these Terms at any time without any special notice by posting a new version of the Terms on the Platform. The new version of the Terms shall enter into force from the moment it is posted on the Platform, unless otherwise provided by the new version of the Terms. If you do not agree with the changes, you may immediately terminate the agreement with us by ceasing to use the Platform. If you continue to use the Platform, this means that you fully agree with the updated Terms. We ask you to periodically check this page to ensure that you agree with the changes.
